Terms and Conditions
By The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, which replaced the Consumer Protection (Distance Selling) Regulations 2000, you may cancel your course anytime within fourteen working days after receiving your course materials in hard copy or online.
To cancel your course you can send your notice of cancellation via email to firstname.lastname@example.org(Cancellations by telephone will not be accepted).
In line with The Consumer Rights Act 2015, you also have a 14 day right to change your mind and get a full refund for digital content, i.e. Online courses, that you have purchased, unless you have already started to view the manuals or any other content received, download it or accessed the material in any other form. If the course has been started, then we will not be able to issue a refund. You must also return any course-related materials and training kits in their original packaging in an unopened re-saleable condition to us at your own cost. We recommend sending any returns via recorded delivery.
In cases where the original packaging has been opened and materials have been used, you will incur a 30% fee from the cost of your course that will be used to cover the costs incurred. In this instance, this will be deducted from your refund. This applies if you haven't started your course yet, please see above.
Upon receipt of cancellation notice and returned course materials at our registered address – and provided the course materials are, at our sole discretion, in resalable condition – we will process the refund due to you within thirty days of our receipt of your written notice of cancellation.
Regarding flexible payment plans, money can only be refunded if you cancel your payment plan within 14 days of the date of enrolment.
If you have ordered a machine and wish to cancel your order, there is a 10% deduction plus a duty fee from the total price. If the machine has been already posted to you, the student will have to pay the return postal charge.
We may change these terms and conditions from time to time. Please ensure that you check for any changes regularly, as you are bound by them if you use this site
USER RIGHTS OF ACCESS
You have permission for temporary, non-exclusive use of the site. KBH Training Academy reserves the right to withdraw or change the content of the site and these Terms and Conditions at any time without notifying you and without having any legal responsibility towards you.
You are not allowed to copy, modify, duplicate, create derivative works from, frame, mirror, republish, download, display, transmit, or distribute all or any part of the site.
You are also not allowed to licence, sell, rent, lease, transfer, assign, distribute, display, disclose, or otherwise commercially exploit, or otherwise make the site and/or any documents or online resources (including our digital products after these have been purchased by you) on the site available to any third party.
You are responsible for configuring your computer and software to access the material and content on our site including downloadable files and resources when purchasing our digital products. We do not warrant that the way we deliver data to you is compatible with your software or with the way your mobile device, computer or tablet is configured. Although we do our best to protect our site, we are not responsible for any viruses, bugs, or similar issues. We advise that you use your virus protection software to protect yourself.
You agree to follow our Acceptable Use Policy.
We frequently update the site and make changes to it, but we have no duty to do this. This means that content on the site may be outdated or incorrect. We will have no liability to you for any losses or damage you may suffer from your reliance on any of our materials.
OUR RESPONSIBILITY TO YOU
We do not guarantee the accuracy of material on our site, and you are responsible for the way you use its content.
We shall not limit or exclude our liability for:
death or personal injury.
fraud or fraudulent misrepresentation; or
any act, omission or matter, liability for which may not be excluded or limited under any Applicable Law.
We shall not be liable to you for any indirect, special or consequential loss or damage, including:
loss of profit;
loss of goodwill;
loss of savings; or
loss of contract.
We also exclude, but only as far as legally possible, all terms and warranties or promises implied by law or by statutes.
If you do anything which is a criminal offence under the Computer Misuse Act 1990 (such as; introducing viruses, worms, Trojans and other technologically harmful or damaging material) your right to use the site will end immediately, and we will report you to the relevant authorities and provide them with details of your identity.
You must not try to obtain access to our server or any connected database or make any ‘attack’ on the site.
We are committed to dealing with any complaints quickly and effectively.
Any support complaints should be addressed in the first instance to your tutor. If you are unhappy with the outcome of their response, then you are requested to put your complaint in writing to the Course Director and email it to email@example.com.
All training manuals, materials, pictures, videos or any website content and anything you receive from us is the sole property of KBH Training Academy and any attempt to copy or use without our consent or share any part of our material with 3rd party will be prosecuted. You cannot publish nor share our training manual, materials, pictures, or videos on your social media without our consent nor you can share it with anyone else.
You have 12 weeks to complete the course from the date of purchase before it expires (course material will be emailed over to you; please refer to “ how to complete online course section”. No hard copy will be issued). We do not make exceptions, so please re-ensure you commit to your course and complete it within the above timeframe as no refund will be given on any occasion. If you require an extension this must be done before your course expiration date. Any extension requests after this period will be treated as a new course booking and the full price of the course must be paid except the cost of the kit. You have access to your training manual and any coursework whilst you study. The access will be removed after your course expires. We advise students to make notes whilst they study so they can refer to me later.
Covid-19 and other pandemics
If you decide to purchase any training course during a pandemic, please reinsure, you will be able to finish it within the given time scale(3 months). This includes completing your practical assignment on live models as well. By purchasing a course during a pandemic, the student is responsible to finish their course in time as no further free extension or refund will be offered. The additional extension can be purchased for a fee on our website. If you require an extension this must be done before your course expiration date. Any extension requests after this period will be treated as a new course booking and the full price of the course must be paid except the cost of the kit.
Once you purchase your course, we will call you and arrange the date and time for your practical assessment. You are required to complete your practical assessment within a month of purchase. Any booking fees paid towards the course are non-refundable in case of cancellation, no show or date change. If full payment has been made, we will refund 50% of the course fee if you wish to cancel your course. This must be done no later than 7 days before your assessment day otherwise no refund will be offered. In case of no show or late cancellation, no refunds will be offered. We require 7 days’ notice for date change, anything less will incur a fee of £50. You are required to bring a model with you for a practical assignment. If your model cancels on you the above terms will apply.
We are happy to offer our courses to you, however, by purchasing any of our courses you are entering into an agreement that you will not offer the course purchased for the next 6 months. This is to protect our course material from being copied as well as reinsuring you get enough practice in the treatment you are going to teach. If you or anyone you work with/for will offer this course earlier than a stated time frame, we will be taking legal action and treat this as a breach of our terms and conditions and your qualification will be revoked with immediate effect.
Please note that it can take up to 3 weeks for your course kit to arrive if you have purchased one. If you have ordered a machine and wish to cancel your order, there is a 10% deduction plus a duty fee from the total price. If the machine has been already posted to you, the student will have to pay the return postal charge. Once your items have been shipped, it's the buyer's responsibility to keep an eye on the delivery. As we usually use royal mail or Hermes as our main shipping providers, we are not able to control the deliveries once handed over to them. If you miss your delivery and the package is returned to us, you will have to cover the postal charges again. We provide tracking information upon request. All other items: processing time is 1 working day and delivery 1-2 working days.
Machines & Devices
There is 6 months warranty on the main body of the machine and 3 months on the handles. Devices come with 3 months warranty, we won't be able to refund or replace the item after this time. If there is a manmade issue, we will not be able to accept a return and offer a refund, replacement, or repair. Any cosmetic issues such as cracked screens etc aren’t part of a warranty. Buyers must pay for the postage if they want to return, repair or replace the machine. You must check the machine and devices within 5 working days from the date you receive it. If we won't hear back from you, we will assume your machine/device is in full working order. If at any point, you will experience issues with the machine/device during your warranty period, you must contact us immediately and supply pictures and videos upon request. If we agree on repair, the buyer is responsible to pay for return postage. Machine/devices must be received within 7 working days from the date we have agreed on return. If we won't receive the machine within the given time scale, we won't be able to accept it. If you continue using the machine/device after you have told us there is an issue and have not returned the machine/device to us, your warranty will be automatically waved as by continuing to use the machine/device you would have caused more damage willingly.
Booking fees are non-refundable in case of cancellation or no show for any of our courses. Courses in person, and deposits are non-refundable or transferable.
Your case of studies pictures might be used on our social media and by accepting the terms and conditions you are permitting us to do so
You are responsible to check the requirements of your state/country when importing goods. It's the student’s sole responsibility to check before purchasing the course, whether the qualification and the machine/item/products are acceptable in their country/ state. We do not offer refunds on courses and items that are not allowed in your state/country. KBH Training Academy will not be responsible if your goods are seized or returned to us. In case the items are returned to us by the border force, we will refund the full amount minus postage once we receive the goods. In case the items will be seized and destroyed we will not be able to refund you. Please note, that it is your responsibility to check all the requirements before ordering any items from us and you do so at your own risk
You are responsible for your insurance. We strongly advise that you contact insurance providers before booking any of our courses. We are training providers not insurance brokers hence we cannot provide or guarantee your insurance. KBH will not be held responsible if you cannot gain insurance upon course completion.
